WILL OF Sarah BERRY
Ref CH145 TU2666 1926
I Sarah Ann Berry wife of James Berry of Waimate in the Provincial District of Canterbury in New
Zealand Farmer hereby revoke all former Wills and declare this to be my last Will and Testament I
appoint my husband the said James Berry (hereinafter called 'my Trustee') to be Executor and
Trustee of this my Will
I give devise and bequeath all my property real and personal whatsoever and
wheresoever unto my Trustee Upon Trust to sell call in and convert into money all such parts thereof
as shall not consist of money (with power in his discretion to postpone such sale calling in and
conversion for such period as he shall think fit without being responsible for loss) and after payment
thereout of my debts and funeral and testamentary expenses to stand possessed of the provceeds
thereof upon trust to pay and divide equally between my said husband and all my children living at
my death share and share alike.
And I declare that if any child of mine shall die in my lifetime leaving
issue such issue shall take and if more than one in equal shares the share which his her or their
parent would have taken had he or she survived me
In witness whereof I have hereunto subscribed my name this 6th day of August one thousand nine
hundred and twenty.

I James Berry of Waimate in the Provincial District of Canterbury in New Zealand Farmer hereby
revoke all previous Wills and declare this to be my last Will and Testament.
1 I appoint my son-in-law George Thomas Smith of Waimate (hereafter called 'my Trustee') the
Executor and Trustee of this my Will
2 I give devise and bequeath all my property real and personal whatsoever and wheresoever unto
my trustee upon trust to sell call in and convert the same into money (with power in his discretion to
postpone such sale calling in and conversion for such period as he shall think fit without being
responsible for loss) and after payment thereout of my debts and funeral and testamentary expenses
to stand possessed of the proceeds of such sale calling in and commission and my ready money
and of all parts of my estate for the time being uncommitted upon trust.
a to pay the income thereof to my wife for her life and after her death
b To pay to my son George the sum of fifty pounds
c To pay and divide the capital and income of my estate equally between all my children including
my said son George
