WILL OF HENRY ISTED, the elder of EAST GRINSTEAD,Yeoman 1778




I, Henry ISTED the Elder of East Grinstead in the County of Sussex, Yeoman, being in perfect health and of sound disposing mind memory and understanding (praised be God) do make this my last Will and Testament in manner and form following:

principally I resign my soul to God who gave it, and my body to the Earth to be therein devoutly buried at the discretion of my Executors hereafter named And as touching all my Temporal Estate wherewith it hath pleased Almighty God to bless me, I give and dispose thereof as follows (that is to say)

I give and devise and bequeath all my Estate both Freehold and Copyhold of which I shall die possessed unto my dear and loving wife Mary for and during the term of her natural life but with impeachment of waste and also what bedds and ffurniture, linen and plate she shall think proper to take during the term of her natural life and from and after her decease, I give devise and bequeath the same in manner and form following (that is to say)

I give and devise all that Messuage or Tenement Farm and Lands Called "Gothlands" with their appurtenances situated lying and being at Nutley in the Parish of Maresfield in the County of Sussex aforesaid and now in the occupation of Durrant CLARE or his assignees, and also all that Messuage or tenement with the appurtenances situate and being in the Borough of East Grinstead and now in the occupation of John HAYWARD, Collarmaker or his assignees, unto my son James ISTED his heirs and assignees for ever.

Also I give and devise all that my Messuage Farm and Lands with their appurtenances situate and living in the Parish of Hoathly in the County of Sussex aforesaid and now in the occupation of John POTTER his under tenants or assignees called or known by the name of "Busseys" or by what other name or names the same is called or known unto my son Edward ISTED for and during the term of his natural life with impeachment of waste. But it is my will that if my said son Edward ISTED shall and do not abide with and maintain his wife and children until his said children shall be capable of providing for themselves, that then I do hereby order and direct that the Tenant or Tenants of the said Farm called "Busseys" for the time being shall and do pay his and their rent to the wife of the said Edward ISTED (if living), and after her decease to such person or persons who shall have the care of the child or children of the said Edward ISTED during their minority and her his and their receipt or receipts from time to time shall be a sufficient discharge for the same, and from and after the decease of the said Edward ISTED I give and devise the said Farm and Lands called "Busseys" unto Henry the son of the said Edward ISTED his heirs and assignees forever, but not till after the other children of the said Edward ISTED shall arrive to the age of twenty-one years it being my intention that the rents and profits thereof shall be applied to bringing up the family.

Also I give and devise all that Copyhold messuage or tenement Farm and Lands called "Brookhouse and Brooklands" situated ,and being in the Parish of East Grinstead aforesaid and now in my own occupation which said premises are holden of the Manor of Imberhorne having first surrendered the same to the use of this my will unto my son William ISTED for and during the term of his natural life and from and after his decease I give and devise the same to and amongst all his children which shall be living at the time of his decease as tenants in common.

Also I give and devise all that messuage or tenement Blacksmiths Shop with the Garden and appurtenances situate lying and being near the street at Hoathly aforesaid and now in the occupation of my son in law Michael BURGESS unto my daughter Elizabeth the wife of the said Michael BURGESS and to her heirs and assignees for ever.

Whereas I have now standing in my name in the books of the four per cent Consolidated Annuities at the Bank of England the capital sum of one thousand two hundred pounds, now I so hereby give the interest and dividends hereof to my said wife during her life and after her decease I give and bequeath the said capital sum of one thousand two hundred pounds unto and equally between my Daughters (viz) Mary, Ann, Sarah, Susannah, and Hannah share and share alike. And in case any or either of them shall die before she or they shall become entitled to her or their respective proportion or proportions thereof, then I give such proportion or proportions of her or them so dying to and equally among the child or children of her or them so dying and if no child or children to and among the survivor or survivors of my before named five daughters share and share alike.

Also I give and bequeath unto my said son Edward ISTED the sum of one hundred pounds of like lawful money to be paid unto him by my Executor here after named and of my live and dead stock in six months after the death of my said wife. Also I give and bequeath unto my said son Edward ISTED after the decease of my said wife one half part of all such furniture linen and plate which shall have been made choice by my said wife and also one half part of all other my furniture, linen and plate which I shall die possessed of, and also one half part of all my wearing apparel to be had and taken by him in three months after my decease and the decease of my said wife respectively.

Also I give and bequeath unto my said son William ISTED after the decease of my said wife one other half part of all furniture linen and plate which shall have been made choice of by my said wife and also one other half part of all other my furniture linen and plate which I shall be possessed of, and also one other half part of all my wearing apparel to be had and taken by him in three months after my decease and the decease of my said wife respectively

Also I give and bequeath unto my daughter Elizabeth the sum of one hundred pounds of like lawful money to be paid to her by my said Executor in six months after the death of my said wife and out of my live and dead stock.

Also I give and bequeath unto my said wife the interest of three hundred pounds which I have now out upon Bond during the term of her natural life to be paid to her by my Executors hereafter named as the same shall become due and from and after her decease I give and bequeath the said Bond with the principal money due thereon unto and equally to be divided between my said five daughters namely Mary, Ann, Sarah, Susannah and Hannah share and share alike. Which Bond I do hereby direct shall be delivered to them or one of them in three months after my wife's decease, and in case any or either of them shall die before she or they shall be entitled to her or their respective legacy or legacies therein, I give the legacy or legacies of her or them so dying to and equally among the child or children of her or them so dying and if no child or children to and among the survivor or survivors of my before named five daughters share and share alike.

Also I give and bequeath unto my son Henry ISTED the sum of five shillings to be paid him in one month after my decease by my Executor hereafter named, all the rest residue and remainder of my Estate of what nature and kind so ever after payment of my just debts, legacies aforesaid, funeral expenses probate of this my will and all other necessary expenses and outgoings occasioned by my death.

I give and bequeath unto my said son William ISTED his Executors Administrators and assignees for ever and I do hereby nominate constitute ordain and appoint my said son William ISTED sole Executor of this my Will and I so hereby request that Mr Thomas WAKEHAM and Mr Robert TURNER both of East Grinstead aforesaid will be overseers and trustees to this my will, and if any disputes shall arise touching this my will that their judgment and determination shall be final therein, and I do hereby order my said Executor to reimburse them the said Thomas WAKEHAM and Robert TURNER for their time and trouble and expenses occasioned in and about the same

And lastly I do hereby revoke all former wills by me heretofore made and declare this to be my last will and testament in witness whereof I have to this my last will and testament contained in these four sheets of paper to each sheet hereof set my hand and seal this eighteenth day of June in the eighteenth year of the reign of our Sovereign Lord George the third by the grace of God of Great Britain France and Ireland King Defender of the Faith and so forth, and in the year of our Lord One thousand Seven Hundred and Seventy Eight.
